Terms And Conditions By using your SUBCARD™you agree to these terms and conditions (Terms). If you have any questions about your SUBCARDTM, call 0800 78 22 73 or write to PO Box 300-101, Albany Mega Centre, Auckland. SUBWAY® Reward Dollars will automatically expire one year after the date that you earn them. Expiry of cash balances which you load onto your SUBCARD™ will automatically expire two years after the date that you loaded the cash onto your SUBCARD™. When your loaded cash or SUBWAY® Reward Dollars expire, you can no longer use them, and have no right to any refund. If you wish to redeem your SUBWAY® Reward Dollars for approved SUBWAY® products or spend your cash balance, you must do so before they expire. Ownership of your SUBCARD™ Your SUBCARD™ and card number are the property of Subcard NZ Limited. You must not copy or reproduce your SUBCARD™. Registering your SUBCARD™ Register your SUBCARD™ by: • logging on at www.subcard.co.nz ,follow the links and use the PIN number provided with your SUBCARD™; or • Filling in the SUBCARD™ application form and posting it to PO Box 300-101, Albany Mega Centre, Auckland Nature of your SUBCARD™ Your SUBCARD™ can be used as: • a Gift Card or Purchase Card to purchase products at SUBWAY® restaurants; and/or • a Rewards Card to collect SUBWAY® Reward Dollars towards approved SUBWAY® products. SUBCARD™ is not a credit or charge card and cannot be exchanged for cash. Using your SUBCARD™ as a Gift Card/Purchase Card You can load your SUBCARD™ with cash up to a maximum of NZ$500 at any SUBWAY® restaurant. You can reload your SUBCARD™ with additional cash at any time. Cash loaded onto your SUBCARD™ can be used to purchase products at SUBWAY® restaurants. Earning SUBWAY® Reward Dollars You can earn SUBWAY® Reward Dollars every time you make a purchase at a SUBWAY ® restaurant and present your SUBCARD™ at the cash register. The points value for calculating SUBWAY® Reward Dollars may change from time to time without prior notice to you. You cannot earn SUBWAY® Reward Dollars for the following: • when loading cash onto your SUBCARD™; or • when making a purchase using SUBWAY® Reward Dollars. If you return a product or receive a refund on a product, we reserve the right to reverse the SUBWAY® Reward Dollars earned for the original purchase. No SUBWAY® Reward Dollars will be earned on previous or historical purchases. Redeeming SUBWAY® Reward Dollars You can redeem your SUBWAY® Reward Dollars for approved SUBWAY® products. You must have a minimum balance of three (3) SUBWAY® Reward Dollars on your SUBCARD™ before you are eligible to redeem your SUBWAY® Reward Dollars for approved SUBWAY® products. Reward dollars cannot be redeemed for cash. Approved SUBWAY® products are subject to availability and may be withdrawn or substituted at any time. We will deduct the appropriate number of SUBWAY® Reward Dollars from your balance when you redeem SUBWAY® Reward Dollars for approved SUBWAY® products. SUBWAY® Reward Dollars cannot be transferred to any other card or reward programme at present, but this option may be available in the future. Information about your SUBCARD™ Details of your cash balance and SUBWAY® Reward Dollars, if any, will appear on your receipt each time you make a purchase using your SUBCARD™ at SUBWAY® restaurants. You can also check details of: • your cash balance; • your SUBWAY® Reward Dollars; and • your SUBCARD™ expiry date; by logging on at www.subcard.co.nz and follow the links. Lost or stolen cards You must notify us immediately by calling 0800 78 22 73 if your SUBCARD™ is lost, stolen or destroyed. Provided your old SUBCARD™ was registered, we will issue you with a replacement SUBCARD™ and freeze the remaining SUBWAY®z Reward Dollars and cash balance on your old SUBCARD™ from the time that you report to us that your SUBCARD™ is lost, stolen or destroyed. To credit a replacement SUBCARD™ with previously earned SUBWAY® Reward Dollars or a previously loaded cash balance we will require proof of your identity (including photo identifi cation). The crediting of a replacement SUBCARD™ is at our sole discretion. No sale/conversion You cannot sell or convert your SUBWAY® Reward Dollars or cash balance into cash. New Zealand only Your SUBCARD™ can only be used at SUBWAY® restaurants in New Zealand. Variation of these Terms We reserve the right to vary, suspend, modify or terminate these Terms at any time without prior notice. Any changes to these Terms will be posted on the www.subcard.co.nz. Cancellation of your SUBCARD™ We reserve the right to cancel your SUBCARD™ at any time without prior notice. Where we cancel your SUBCARD™, any unused SUBWAY® Reward Dollars or cash balances will be valid for three months from the date of cancellation, after which any unused SUBWAY® Reward Dollars or cash balances expire. The three month validity period does not apply to a SUBCARD™ which is lost, stolen or destroyed. You can cancel your SUBCARD™ by writing to PO Box 300-101, Albany Mega Centre, Auckland. Where you cancel your SUBCARD™, any unused SUBWAY® Reward Dollars or cash balances will expire immediately. Privacy Statement Our Privacy Statement can be viewed at www.subcard.co.nz. Limitation of liability To the extent permitted by law, we will not be liable for: • any delay in replacing your SUBCARD™; • any unauthorised use of your SUBCARD™; • any approved SUBWAY® product not being available for any reason; • any failure to notify you of any changes in these Terms; or • any failure to notify you of cancellation of your SUBCARD™. All conditions and warranties, whether express or implied and whether arising under legislation or otherwise, as to the condition, suitability, quality, fi tness or safety of any goods or services supplied under or in relation to your SUBCARD™ are expressly excluded to the full extent permitted by law. Any liability we may have to you under legislation in respect of such goods and services which cannot be excluded is limited, where permitted, to supplying, or paying the cost of supplying, the goods or services again. You may have rights under the Consumer Guarantees Act 1993 which are not excluded or limited by anything set out in these Terms. Each exclusion or limitation of liability in these Terms also applies to the owners and operators of SUBWAY® restaurants, Subway Franchisee Advertising Fund Trust, Doctor’s Associates, Inc., SUBWAY® Development Agents and their related companies (as defined in the Companies Act 1993), employees and agents. |
